Clare Councillor to vigorously contest allegations in High Court case

Kildysart Councillor Oliver Garry has said he’ll "vigorously contest" allegations that he and his sons have been used up to 400,000 euro of their company money for their own personal gain.

The West Clare Fine Gael Councillor was reacting to a law suit being taken in the High Court by his brother Edward Garry who’s a 15% shareholder in the family’s construction and plant hire company.

Councillor Oliver Garry and his sons are being sued by Edward Garry, on behalf of Abbey Contractors with the case listed for hearing before the High Court next week.

Last evening the court heard allegations that around 400 thousand Euro has been withdrawn from the company for the personal use of Councillor Garry and his sons John and Colin over a 6 to 7 year period.

The councillor’s brother  – Edward Garry  –  a  shareholder in the plant hire business who is based in Dublin  –  also claims that his nephew Colin Garry had a large house built for him by the company which he never paid it for.

His lawyers applied for an order directing the return of  33 thousand Euro of company funds allegedly withdrawn by John and Colin Garry on December 21 as redundancy payments but Mr Justice Patrick McCarthy refused saying he couldn’t grant the injunction when the other side was not represented in court as the claim could be unfounded.

In a statement to Clare FM Councillor Oliver Garry said he wasn’t formally notified of the application before the courts last evening, arising out of a dispute between himself and Edward Garry but he regards the claims made in court as totally unfounded, adding that he intends to contest them vigorously.
